Welcome to DreamBuilder AI. These Terms of Service ("Terms") govern your use of our Windows desktop application, website (dreambuilds.icu), and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using DreamBuilder AI, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use DreamBuilder AI. By using our Services, you represent and warrant that you meet these requirements.

3. License Grant

3.1 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use DreamBuilder AI on Windows devices you own or control for personal, non-commercial purposes.

3.2 Restrictions

You may not:

• Copy, modify, or create derivative works of the software
• Reverse engineer, decompile, or disassemble the application
• Rent, lease, lend, sell, or sublicense the software
• Remove or alter any proprietary notices or labels
• Use the software for any illegal purpose
• Circumvent any security or access control mechanisms
• Use the software to create designs that violate building codes or safety regulations

4. User Accounts

To access certain features, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and current information

5. User Content and Designs

5.1 Ownership

You retain all intellectual property rights to the designs you create using DreamBuilder AI. We do not claim ownership of your designs.

5.2 License to Us

By using our Services, you grant us a limited license to:

• Store and process your designs to provide the Services
• Use aggregated, anonymized design data to improve our AI models
• Display your designs to matched builders (only if you use Realization Service)

5.3 Responsibility for Designs

You are solely responsible for the designs you create and any use of those designs. We recommend having all designs reviewed by licensed architects or engineers before construction.

6. AI-Generated Content and Estimates

6.1 No Guarantees

While our AI is trained on thousands of construction projects, we do not guarantee that:

• Designs will meet all local building codes and regulations
• Cost estimates are accurate or final
• Designs are structurally sound without professional review
• Designs can be built exactly as created

6.2 Professional Review Required

All designs should be reviewed by licensed professionals (architects, structural engineers, contractors) before construction. DreamBuilder AI is a design tool, not a substitute for professional expertise.

7. Realization Service

7.1 Matchmaking Only

Our Realization Service connects you with builders in our network. We are not a construction company and do not perform construction work ourselves.

7.2 No Endorsement

While we vet builders in our network, we do not endorse, guarantee, or assume responsibility for their work, pricing, or conduct. Any agreements are between you and the builder.

7.3 Your Responsibility

You are responsible for:

• Verifying builder credentials and licenses
• Negotiating contracts and payments directly with builders
• Obtaining necessary permits and inspections
• Ensuring compliance with local regulations

8. Fees and Payments

8.1 Free Software

DreamBuilder AI is currently free to download and use for design purposes. We reserve the right to introduce paid features in the future.

8.2 Realization Service Fees

If you use our Realization Service, builders may pay us a referral fee. This does not affect your pricing or the services you receive.

9. Intellectual Property

DreamBuilder AI, including the software, AI models, algorithms, trademarks, and all related intellectual property, is owned by us and protected by copyright, trademark, and other laws. Nothing in these Terms grants you any ownership rights.

10. Acceptable Use

You agree not to:

• Violate any laws or regulations
• Infringe on others' intellectual property rights
• Harass, abuse, or harm others
• Spread malware or viruses
• Interfere with or disrupt the Services
• Attempt unauthorized access to our systems
• Use the Services for commercial purposes without permission

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Services will be uninterrupted or error-free
• Warranties regarding accuracy, reliability, or quality
• Warranties that defects will be corrected

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages resulting from construction based on designs created with our software
• Damages from builders or contractors in our network
• Any damages exceeding $100

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Services
• Your designs and any construction based on them
• Your violation of these Terms
• Your violation of any laws or third-party rights

14. Termination

14.1 By You

You may stop using the Services and delete your account at any time.

14.2 By Us

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Discontinuation of the Services

14.3 Effect of Termination

Upon termination, your license ends, and you must stop using the Services. We may delete your account and designs, though we'll provide reasonable notice when possible.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or in-app notification. Continued use after changes constitutes acceptance of the updated Terms.

16. Governing Law and Disputes
